TERMS & CONDITIONS – ESSBAKES

By placing an order with EssBakes, you agree to the following Terms & Conditions.

 

 Orders & Payments

A minimum of 14 days notice is required for all celebration cake orders.

Orders are only confirmed once a deposit or full payment has been received,

Remaining balances must be paid 5 days before collection.

Deposits are charged at 40% upon booking, with 60% due 5 days before due date for all celebration cakes


 Last minute orders are classified as any order placed with less than 3 days’ notice and are subject to availability.
Last minute orders require full payment upfront.
For orders under £50, full payment is required upon booking.

Cancellations, Payments & Refunds

All deposits made to EssBakes are non refundable and non transferable once an order has been confirmed due to the bespoke nature of our products and preparation time required.

 

Remaining balances must be paid by the agreed payment deadline stated upon booking.

 

Failure to complete payment by the agreed due date may result in cancellation of the order. 

Any payments already made, including deposits, are non-refundable.

 

Full or partial refunds may be considered at EssBakes’ discretion where required under applicable consumer laws.

Rescheduling

In certain circumstances, orders may be rescheduled, subject to EssBakes’ availability.

Deposits may be transferred to a new date if rescheduling is requested within 4 weeks of the original booking date and subject to availability.

Rescheduling requests made outside of this timeframe will require a new deposit.

EssBakes Cancellations

In the unlikely event that EssBakes must cancel an order due to unforeseen circumstances, a full refund of any payments made will be issued.

Refunds will be processed to the original payment method within 5 business days.

Processing times may vary depending on the customer’s bank or payment providers

Missed Collections & No Communication

Customers are responsible for collecting orders within their agreed collection window unless otherwise arranged.

Fully paid orders that are not collected and where no communication has been received, will be held for up to 24 hours where possible.

After this timeframe, if no contact has been made, EssBakes reserves the right to dispose of, dismantle, resell, or otherwise repurpose the products without refund or compensation.
In the event of missed payments, despite payment messages being sent, cake orders will not be going ahead.

 

Refunds policy 

Refunds, partial refunds, replacements, or order credit may be considered in circumstances including:

-Significant errors made directly by EssBakes

-Incorrect flavours, sizes, or quantities supplied

-Major design elements missing that were previously confirmed and agreed

-Products found to contain a genuine quality or food safety issue directly caused by EssBakes

-Structural or quality issues identified prior to collection or delivery

-Orders cancelled directly by EssBakes

Refunds will not be issued for personal taste preferences, including sweetness levels, buttercream quantity, texture preferences, or flavour choices once these have been selected and approved by the customer. 

 

Custom Designs

While every effort is made to match requested designs, exact replicas are not guaranteed.

Colours and finishes may vary slightly due to lighting, materials, and interpretation.

EssBakes reserves the right to apply creative judgement where necessary.

No design changes can be made within 48 hours of collection

Cake messages must be confirmed 48 hours before due date.

Customer and cake safety 

EssBakes will always advise the customer if non-edible decorative elements are used.

 

Customers are responsible for ensuring all non-edible elements are removed before serving or consumption. Cake smashes involving structural or non-edible elements are strongly discouraged due to safety risks.

Collection Information

Standard collection hours are between 12pm–2pm unless otherwise arranged.

Evening collection slots may be available upon request strictly between 7pm–7:30pm, and are subject to availability.

Customers are provided with a 30-minute collection window and are expected to arrive within the agreed timeframe.

Customers are responsible for informing EssBakes as soon as possible if running late.

As EssBakes operates on a strict schedule with multiple orders and commitments, availability outside of the agreed collection time cannot be guaranteed.

Late Collections

Collections delayed by more than 1 hour without prior communication may incur a late fee of £5.

Repeated missed or significantly delayed collections may result in future bookings being declined.

Cake pictures and responsibility 

Photographs of completed orders will be shared with customers on the morning of collection where possible.

Images are typically sent by 10am for customer approval.
We kindly request for customers to respect this timeframe, and avoid asking for pictures constantly. 

Any concerns, corrections, or amendments must be raised immediately before collection takes place.

For orders containing multiple items, including cakes, cupcakes, dessert cups, or treat boxes, final quantities and order details will be repeated back to the customer, post fulfilment.

Customers are responsible for carefully reviewing and approving all order details, including quantities, spelling, colours. 

EssBakes cannot be held responsible for errors that were approved or not corrected by the customer before collection.

Responsibility After Collection

Once the order has been collected, full responsibility transfers to the customer.

EssBakes is not liable for any damage occurring during transport, handling, setup, or storage after collection.

Customers are responsible for transporting cakes safely on a flat surface and storing products appropriately after collection.

Delivery and responsibility:

EssBakes offers both customer arranged collection services and courier delivery options, subject to availability.

Customer-Arranged Uber Collection

Delivery slots are available between 12pm–7pm.

Customers are welcome to arrange their own Uber collection at their own risk.

Please note:

Uber collections must be booked using standard Uber passenger services only. 

Uber Courier services are not permitted.

Customers must inform their driver in advance that a cake collection is required, as some drivers may refuse transportation of fragile items.

An estimated arrival time and tracking link must be shared with EssBakes prior to collection.

If a driver cancels, refuses collection, or fails to arrive, arranging an alternative driver remains the customer’s responsibility.

EssBakes is not responsible for any delays, damages, cancellations, mishandling, or transport related issues once the order has been handed over to the customer’s chosen driver.

Late fees may be charged if a customer has not informed us of any delays prior to booking their uber, late fees are £5 per hour.

Courier Delivery Service
EssBakes can arrange delivery via a trusted courier service for an additional charge.

Delivery slots are available between 12pm–7pm.

While every effort is made to deliver within the agreed timeframe, exact delivery times cannot be guaranteed due to traffic, weather conditions, or unforeseen circumstances.

Customers are encouraged to select earlier delivery slots where possible to avoid delays impacting their event.

Kerbside Delivery Policy

All deliveries are strictly kerbside only.

Delivery drivers are not responsible for carrying cakes into homes, venues, apartments, or upper floors.

Customers must be available to collect the order directly from the vehicle upon arrival.

If no communication is received and the driver is required to wait longer than 15 minutes, the order may be returned to the EssBakes studio. 

Any redelivery or rearranged delivery will incur an additional delivery charge

 

Customer Responsibility regarding deliveries 

Customers are responsible for providing accurate delivery details, including the full address, postcode, recipient name, and contact information.

EssBakes is not liable for delays, failed deliveries, or additional charges resulting from incorrect or incomplete information provided by the customer.

Any address amendments requested after dispatch may incur additional charges.

Prior to delivery or collection, photographs of the completed cake will be shared for confirmation purposes.
Any concerns or corrections must be raised before the order leaves the premises.

Once the cake has been collected, delivered, or handed over to the customer, via Uber driver, courier, or designated recipient, full responsibility transfers to the customer.

EssBakes and any third-party delivery drivers are not liable for any damage occurring during transport, handling, setup, or storage after handover.

Customers are responsible for ensuring cakes are transported safely and stored appropriately after collection or delivery.

Any concerns regarding an order must be reported within 6 hours of collection or delivery and supported with photographic evidence where applicable​

Transport & Storage

Customers are responsible for following all transport, storage, refrigeration, and serving instructions provided by EssBakes.

Cakes must be transported on a flat surface in a cool, secure environment away from direct sunlight or heat.

EssBakes cannot be held responsible for changes in texture, cracking, instability, condensation, or damage resulting from failure to follow provided aftercare instructions.

Cake damages

Repair, amendment, or reconstruction services are only applicable in cases where damage has occurred after collection due to customer handling, transport, storage, setup, or other customer-related circumstances, including but not limited to reckless driving, sudden movement during transport, improper storage, or accidental mishandling.

EssBakes reserves the right to assess the condition of the cake before agreeing to any repair or reconstruction work

 

​Damage Amendments & Reconstruction

In cases where minor damage occurs after collection, including small smudges, buttercream cracks, or minor decorative movement, EssBakes may offer repair services subject to availability.

Minor repair work is charged from £15 depending on the extent of the damage and time required.

In cases of significant damage, including collapsed cakes, broken internal structure, severe transport damage, or heavily damaged edible decor, full reconstruction work may be required.

Reconstruction services are charged from £75 and are subject to availability.

Reconstruction or emergency repair work may require up to 2 hours before the order is ready for recollection.

While every effort will be made to assist customers where possible, EssBakes cannot guarantee immediate repair availability, particularly during busy periods or where multiple orders are scheduled.

Once a cake has been collected or handed over for delivery, full responsibility transfers to the customer.

EssBakes is not liable for any damage occurring after collection or delivery where appropriate care and transport instructions have been provided.

Customers are responsible for ensuring cakes are transported on a flat, secure surface and handled with care at all times.

EssBakes cannot be held responsible for damage caused by sudden vehicle movement, reckless driving, improper handling, unsafe storage, stacking, accidental impact, or customer negligence after handover.

 

Cake Care & Aftercare

EssBakes provides cake care, storage, transport, and serving guidance to all customers prior to collection or delivery.

Aftercare information is provided across the EssBakes social media highlights, on cake care cards included with order, during the enquiry and booking process and via mandatory acknowledgement within the enquiry form prior to order submission

Customers are required to read and acknowledge all cake care instructions before placing an order.

 

Important Serving Information

Buttercream cakes are best enjoyed at room temperature.

Depending on room temperature and refrigeration time, cakes may require sufficient time to soften before serving.

Serving a cake directly from the fridge may result in a firmer texture.​

Allergies & Storage

Products are made in a kitchen that handles common allergens.

Customers must inform EssBakes of any allergies prior to ordering.

Cakes should be stored in a cool, dry place and consumed within the advised timeframe.

Products are prepared in a kitchen that handles common allergens including dairy, eggs, wheat, and soy.

While nuts are not intentionally used in our products, EssBakes cannot guarantee a completely nut-free environment due to supplier manufacturing and potential cross-contamination risks.

 Cake Classes / Workshops

Class bookings are non-refundable but may be transferred with prior notice.

A minimum of 48 hours’ notice is required for any changes.

EssBakes reserves the right to reschedule classes if necessary.

Digital Products

All digital products are non-refundable.

Products are for personal use only.

Redistribution, resale, sharing, or copying is strictly prohibited.

 

 Intellectual Property & Copyright

All content, including text, images, branding, and digital products, is the property of EssBakes and is protected by copyright laws

You may not copy, reproduce, distribute, modify, or resell any content without prior written permission.

 

 Limitation of Liability

EssBakes shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or services.

Customers accept full responsibility for the handling, storage, and consumption of all products after collection.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

Disclaimer (No Guarantee of Results)

While guidance and advice (including digital products) are created based on experience and best practices, EssBakes does not guarantee specific outcomes, including food hygiene inspection results.

 

Privacy & Data Protection

Customer information is collected solely for order processing and communication purposes.

EssBakes does not share or sell personal data to third parties.

 

Payments, Fraud & Chargebacks

All payments are processed securely via third-party providers.

Any fraudulent chargebacks will be disputed with supporting evidence, including communication records, order confirmations, and proof of service or delivery.

 

 Force Majeure

EssBakes shall not be held liable for failure or delay in fulfilling obligations due to circumstances beyond control, including illness, emergencies, or unforeseen events

CLIENT CONDUCT & COMMUNICATION

To ensure a smooth process for all orders, clients are expected to communicate respectfully, respond within reasonable timeframes, collect orders at the agreed time, and finalise design details before confirmation.

EssBakes reserves the right to decline future bookings in cases of repeated late payments, missed collection times without communication, excessive last-minute changes, or behaviour that negatively affects the booking process.

EssBakes reserves the right to update these terms at any time.
The terms & xonditions applicable to an order will be those in place at the time the booking is confirmed.
